These Terms of Service (the "Terms") govern your use of the website located at gptimage2.design, together with all associated subdomains, APIs, and services (collectively, the "Service") operated by the team behind gptimage2.design ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

gptimage2.design is an independent creative platform that provides a unified interface for generating and editing images using third-party AI image models, including OpenAI's GPT Image family, Google's Nano Banana series, Microsoft's MAI-Image family, and other providers we may integrate over time. We are not affiliated with, endorsed by, or sponsored by OpenAI, Google, or Microsoft. All trademarks belong to their respective owners.

When OpenAI's public "GPT Image 2" API is released, we intend to route supported generations through it. Until then, the Service routes requests to the current best-available models on your behalf.

2. Eligibility and Accounts

You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the Service. By creating an account you represent that the information you provide is accurate and that you will keep it up to date. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials.

3. User Content

"User Content" means any prompts, uploaded reference images, generated outputs, comments, feedback, and other material that you submit to or generate through the Service.

  • Your ownership. You retain all rights in the User Content you submit. You also own the images you generate through the Service to the fullest extent allowed by applicable law and by the upstream model provider's terms.
  • License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and display your User Content strictly as needed to operate, secure, and improve the Service.
  • No third-party training. We do not sell, share, or otherwise disclose your User Content to third parties for the purpose of training their machine-learning models. We may transmit your prompts and reference images to our upstream model providers only to fulfill your generation request, subject to each provider's own terms and data-handling commitments.

4. Acceptable Use

You agree not to use the Service to generate, upload, or distribute content that:

  • Depicts sexual content involving minors or sexualized depictions of real, identifiable individuals without consent
  • Facilitates real-world violence, terrorism, or the creation of weapons (including CBRN)
  • Infringes intellectual-property rights, right of publicity, or privacy of a third party
  • Produces deceptive deepfakes intended to mislead, defame, or defraud
  • Violates applicable laws or the acceptable-use policies of our upstream model providers (OpenAI, Google, Microsoft, etc.)
  • Attempts to reverse engineer, scrape at scale, or circumvent rate limits, usage quotas, or safety systems

We reserve the right to remove content, suspend, or terminate accounts that violate this section, and to cooperate with law enforcement where required.

5. Billing, Credits, and Refunds

  • The Service is priced in credits and offered through one-time top-ups and subscription plans. Credit costs per generation vary with the selected model, quality tier, and output resolution.
  • Unless required by law, payments are non-refundable once credits have been consumed or delivered.
  • Subscription plans auto-renew at the end of each billing period unless cancelled before the renewal date. Unused credits on annual plans roll over for one billing cycle; on monthly plans they expire at period end.
  • Taxes, if applicable, are your responsibility unless we are legally required to collect them on your behalf.

6. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, upstream provider outages, and force majeure events may cause temporary unavailability. We may modify, suspend, or discontinue any part of the Service at any time; we will give reasonable notice for material changes that affect paid plans.

7. Third-Party Providers

The Service relies on third-party providers, including but not limited to OpenAI, Google, Microsoft Azure AI, Cloudflare (R2 object storage), Neon (PostgreSQL), Vercel (hosting), Stripe (payments), and Better Auth (authentication). Your use of the Service is additionally subject to the applicable provider's terms, and we are not liable for outages, policy changes, or content decisions made by those providers.

8. Intellectual Property

The Service's software, UI, trademarks, logos, and documentation are owned by us or our licensors and protected by intellectual-property laws. No part of these rights is transferred to you except as expressly stated in these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED OUTPUTS MAY CONTAIN INACCURACIES, BIASES, OR HALLUCINATIONS; YOU ARE RESPONSIBLE FOR REVIEWING GENERATED CONTENT BEFORE PUBLIC OR COMMERCIAL USE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, gptimage2.design SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST OPPORTUNITIES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless gptimage2.design and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your User Content, (b) your violation of these Terms, or (c) your violation of any third-party right.

12. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may cancel your subscription or delete your account at any time from your dashboard. Sections 3, 8, 9, 10, 11, and 13 survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which gptimage2.design operates, without regard to conflict-of-law rules. Any dispute arising from these Terms shall first be attempted to be resolved by good-faith negotiation; failing that, the dispute shall be submitted to binding arbitration under the rules of the applicable arbitration center, except that either party may seek injunctive relief in court for intellectual-property infringement.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via the Service or by email. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
